In compliance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD), we inform you that the personal data you provide will be processed by:

2. Data we collect

Through the contact and subscription form on our website we collect the following personal data:

  • Name
  • Email address
  • Phone number

Additionally, through cookies and similar technologies, we may collect browsing data (IP address, browser type, pages visited, time spent on the site). Details are available in our Cookie Policy.

3. Purpose of processing

We process your personal data for the following purposes:

  1. To manage your subscription and maintain our relationship with you.
  2. To send you our newsletter, commercial communications, offers, news and marketing content about our products and services, by email or equivalent electronic means.
  3. To analyse, in aggregate form, the use of the website in order to improve our services (through analytics cookies, subject to your consent).
  4. To comply with any applicable legal obligations.

4. Legal basis

The legal basis for the processing of your data is:

  • The express consent of the data subject (Art. 6.1.a GDPR), granted by ticking the corresponding checkbox in the form, for the sending of commercial communications and the newsletter.
  • Consent for the installation of cookies that are not strictly necessary, pursuant to Art. 22.2 of the Spanish Information Society Services Act (LSSI-CE).
  • Compliance with legal obligations (Art. 6.1.c GDPR) where applicable.

You may withdraw your consent at any time, without affecting the lawfulness of processing carried out prior to its withdrawal.

5. Retention period

We will retain your personal data for as long as your subscription remains active and you do not request its deletion. Once you unsubscribe, your data will be blocked for the periods established by law to address any potential liabilities (generally up to 3 years under the LOPDGDD, or the applicable limitation period for legal actions), after which it will be permanently deleted.

Data collected through cookies is retained for the periods set out in the Cookie Policy.

6. Recipients and data processors

Your data will not be transferred to third parties, except where required by law. However, in order to provide our services, we rely on suppliers acting as data processors, with whom we have signed the relevant contracts pursuant to Art. 28 GDPR:

International data transfers

Some of these providers (Google LLC, Vimeo) may process data in the United States. These transfers are covered by the EU-US Data Privacy Framework approved by the European Commission on 10 July 2023, or, where not applicable, by the Standard Contractual Clauses approved by the Commission.

7. Rights of the data subject

As the data subject, you have the right to:

  • Access: know which of your data we are processing.
  • Rectification: correct inaccurate or incomplete data.
  • Erasure ("right to be forgotten"): request the deletion of your data.
  • Restriction of processing in certain circumstances.
  • Objection to the processing of your data.
  • Portability: receive your data in a structured, commonly used format.
  • Withdraw consent at any time.
  • Not be subject to automated individual decisions.

You can exercise these rights by writing to info@genexys.es or to our postal address, indicating the right you wish to exercise and attaching a copy of your ID or equivalent document.

Likewise, if you consider that the processing of your data does not comply with the regulations, you have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD), located at C/ Jorge Juan, 6 – 28001 Madrid, or via its electronic office: www.aepd.es.

8. Minors

The use of our services and forms is restricted to individuals over 14 years of age, in accordance with Art. 7 of the LOPDGDD. If we detect that we have collected data from a minor under that age without the consent of their parents or guardians, we will delete it immediately.

9. Security

We apply appropriate technical and organisational measures to ensure a level of security suitable to the risk of the processing, in accordance with Art. 32 GDPR, preventing the loss, misuse, unauthorised access, alteration or destruction of the data.

10. Third-party links

The website may contain links to third-party pages over whose privacy policies we have no control. We recommend that you review their policies before providing any data.

11. Modifications

Genexys Technology, S.L. reserves the right to amend this Privacy Policy to adapt it to legislative changes or modifications to its services. We recommend that you review it periodically.
